RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Kentucky law (KRS 365.402) requires a business that makes an automatic renewal or continuous service offer to provide a cost-effective, timely, and easy-to-use way to cancel, and a consumer who accepted the offer online must be allowed to cancel exclusively online.

Under KRS 365.406, a business that fails to comply with these requirements for the first time must provide a prorated refund from the start of the most recent term to the date it was notified of and corrected the error.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.

Please direct any response to me in writing at the address above.

Sincerely,

Jordan Lee
