RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership
Dear Peak Fitness Clubs LLC,
I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.
Colorado law (C.R.S. § 6-1-732) requires a business that offers an automatic renewal contract to a Colorado consumer to provide a simple, cost-effective, timely, easy-to-use and readily accessible way to cancel, such as a one-step online cancellation link or, where the consumer regularly uses the service in person, an in-person cancellation option.
The same law requires the business to send the consumer a written acknowledgment of the renewal terms, the cancellation policy and how to cancel, and to notify the consumer of any material change in the terms together with cancellation information.
Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.
I would prefer to resolve this without further steps.
