RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Arkansas Code § 4-86-112 requires a business that lets a consumer accept an automatic renewal or continuous service offer online to allow the consumer to cancel exclusively online, at will, through a prominent direct link or button or a ready-made cancellation email, without steps that obstruct or delay cancellation.

Under the same law, cancellation must be available in the same medium the consumer used to sign up, a business may not charge for an automatic renewal without the consumer's consent to the offer terms, and a violation is an unfair or deceptive act or practice under the Arkansas Deceptive Trade Practices Act.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.
