RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Tennessee law (Tenn. Code Ann. § 47-18-133) requires a business making an automatic renewal or continuous service offer to provide a toll-free number, email address, postal address or another cost-effective, timely and easy-to-use way to cancel, and a consumer who signed up online must be allowed to cancel exclusively online.

Under the same law, if a business charged the consumer without first obtaining affirmative consent to the automatic renewal terms, it must refund the charge when the consumer asks within 7 days of the charge.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.
