RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Minnesota's automatic renewal law (Minn. Stat. §§ 325G.56 to 325G.62) lets a consumer cancel an automatic renewal or continuous service agreement at any time, requires a seller whose website has account or subscription management features to offer a clear online cancellation option, and bars the seller from using misrepresentations or unfair or abusive tactics to delay or avoid a cancellation.

Under the same law, any good sent under such an agreement without first obtaining the consumer's affirmative consent is an unconditional gift to the consumer; this rule covers goods only.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.
