RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

The Georgia Online Automatic Renewal Transparency Act (O.C.G.A. § 10-1-439.8) requires a business that lets a consumer accept an automatic renewal or continuous service offer online to allow the consumer to cancel online, for example through a clear and conspicuous cancellation link or a ready-made cancellation email.

Under the same Act, goods, wares, merchandise or products sent under an automatic renewal or continuous service agreement without first obtaining the consumer's consent are deemed an unconditional gift (this rule covers goods only).

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.

Please direct any response to me in writing at the address above.

Sincerely,

Jordan Lee
