RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Virginia law (Va. Code § 59.1-207.46) requires a seller making an automatic renewal or continuous service offer to provide a cost-effective, timely and easy-to-use cancellation mechanism that is at least as easy to use as the one the consumer used to sign up, offered through each method the consumer may use to sign up, without requiring the consumer to talk to an agent unless sign-up also required one.

Under Va. Code § 59.1-207.47, goods, wares, merchandise, or products sent under an automatic renewal or continuous service without the consumer's affirmative consent are deemed an unconditional gift to the consumer.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.
