RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership
Dear Peak Fitness Clubs LLC,
I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.
New York General Business Law § 527-a requires a business making an automatic renewal offer to provide a cost-effective, timely and easy-to-use mechanism for cancellation.
Under the same law, goods or services provided without the consumer's affirmative consent to the automatic renewal terms are deemed an unconditional gift.
Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.
I would prefer to resolve this without further steps.
Please direct any response to me in writing at the address above.
Sincerely,
Jordan Lee
