RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership
Dear Peak Fitness Clubs LLC,
I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.
Under Massachusetts Attorney General regulation 940 CMR 38.05, issued under chapter 93A, a business selling a subscription with automatic renewal or other recurring charges must provide a simple way to cancel and immediately stop recurring charges, at least as easy to use as the way the consumer signed up and available through the same medium (for an online sign-up, through the same website or app).
Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.
I would prefer to resolve this without further steps.
