RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership
Dear Peak Fitness Clubs LLC,
I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.
The Illinois Automatic Contract Renewal Act (815 ILCS 601/10) requires a business that makes an automatic renewal or continuous service offer online to let a consumer who accepted online cancel exclusively online, for example through a cancellation link or a pre-formatted termination email.
The same Act requires a cost-effective, timely and easy-to-use cancellation mechanism, such as a toll-free telephone number, email address or postal address, and, for contracts of 12 months or more, a written notice 30 to 60 days before the cancellation deadline.
Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.
I would prefer to resolve this without further steps.
