RE: Notice of Cancellation and Demand for Refund, Peak Fitness monthly membership

Dear Peak Fitness Clubs LLC,

I subscribed to Peak Fitness monthly membership (account M-55812) on January 15, 2025. On July 1, 2026 I requested cancellation by website. After that date I was charged $49.99 on August 1, 2026, $49.99 on September 1, 2026.

Hawaii Revised Statutes § 481-9.5 requires a business making automatic renewal or continuous service offers to disclose how to cancel and to provide a toll-free telephone number, email address, postal address (if it bills the consumer directly), or another cost-effective, timely and easy-to-use way to cancel.

Under the same law, a business that knowingly fails to cancel an automatic renewal or continuous service contract when the consumer asks is deemed to have engaged in an unfair or deceptive act or practice under Hawaii Revised Statutes § 480-2.

Please treat this letter as written confirmation that my subscription is cancelled, and stop all further charges. I also request a refund of $99.98 for the charges made after my cancellation, by October 16, 2026, by check mailed to the address above.

I would prefer to resolve this without further steps.
